Legal Question in Family Law in Nevada

How do I get an annullment?

I live in Texas, but got married in Las Vegas, how do I go about getting the marriage annulled? How much does it cost? What papers do I need? How long does it take? Do I have to appear in court, or can I just mail something in? Please advise.

Re: How do I get an annullment?

It is a relatively easy process if your wife either agrees to it or does not contest it. I will charge $700 for an default annulment and this includes the filing fee and the process server fee. If we have to publish in the newspaper to serve your wife, you will have to pay for the newspaper.

Because you were married in Las Vegas, Clark County has jurisdiction to annul. If it is uncontested or on a default basis, there is no court appearance. If it is a default annulment, it will take about 30 days. If you desire it quicker, I would have to prepare a document for your wife to sign and it would be done in about a week. There would be an extra $100 to have it done because there is a second filing fee of $78.

Re: How do I get an annullment?

Good afternoon, Sir or Madam:

The Nevada Legislature has developed a great basic research site covering all of the statutes and administrative regulations,

including references to Nevada Supreme Court decisions related thereto, available at:

http://www.leg.state.nv.us

You may want to look into the chapters on Dissolution of Marriage on this site. In this regard, I invite your attention to NRS

Chapter 125, which is found at:

http://www.leg.state.nv.us/NRS/CH_125.html

You may want to look into the chapters on Custody and Visitation on this site. In this regard, I invite your attention to NRS

Chapter 125A, which is found at:

http://www.leg.state.nv.us/NRS/CH_125A.html

You may want to look into the chapters on Obligation of Support on this site. In this regard, I invite your attention to NRS

Chapter 125B, which is found at:

http://www.leg.state.nv.us/NRS/CH_125B.html

There may be other laws affecting your ability to resolve a divorce, support or custody problem, which is necessarily beyond the

scope of this reply.

I charge $200.00 per hour for consultation, document review, case analysis, advice, suggesting and recommending alternatives,

legal drafting, telephone calls, legal research and prosecuting or defending divorce, annulment, separate maintenance, support

and custody actions when a client hires me.

If I do not hear back from you by Friday, April 26, 2002, I will assume that you have answered your questions to your own

satisfaction, hired another lawyer, or decided against pursuing the matter.

I hope this is of assistance to you.

Re: How do I get an annullment?

If you and your spouse live in Texas, then Texas has jurisdiction over your marriage and is where you need to file for divorce or annulment, if you qualify. It takes at least 60 days, even if all cooperate and you or your spouse must appear in court. Let me know if I can help.

Re: How do I get an annullment?

Because you were married in Nevada you can get an annullment in Nevada provided there are proper grounds for an annulment such as fraud, etc. You don't have to come to Nevada to complete the paperwork. The costs and attorneys fees average approximately $1,000 +/-. If you have any questions regarding the process or what you can or cannot accomplish in Nevada, please feel free to call me at (702) 562-2300.
