Child Support Garnishment

Is an insurance company settlement check which is being handled by a Personal Injury attorney subject to garnishment or lein for a husband's back child support? The husband has no income at this time, due to injury but is to receive a settlement from an insurance company for an accident he was in. In other words can this asset be attached or garnished?

Yes, personal injury settlements are not exempt from execution or garnishment and can be applied to back child support obligations. You will need to act very promptly to protect your rights. Once the settlement chack is cashed and the injured support obligor has been paid, there is no debt or obligation to attach.
