Late Fees

My tenant has been consistently late

with the rent during her 2 1/2 year

tenancy. Unfortunately, I never

enforced the late fees. She signed a

six month lease in December 2008

and can no longer pay the rent. I am

in the process of a pay or quit. Have

I waived all rights to collect any late

fees whatsoever?

Yes, you've waived late fees at this point. Besides the Justice Of The Peace does not enforce late fees on an eviction. He will tell you to take the issue to Small Claims Court.
