rolled my car got out and off road got 8 beers out of car sat down and drank all of them no one was with me or saw accident cops came 20 min latter and stood next to me as i had more beer ask me to take test i said no told them i was not drinking in car strted after got out of car how can they prove i was d.u.i they saw me drinking when they got there notwhileI was in any vehicle

This will be a test of what the officers observed when connected to your reported behavior. Alcohol does not get into the blood as quickly as you might think. They will report what they saw regarding your actions. The judge will have to determine if those behaviors were sufficient to believe that you were unfit to drive as a result of consuming alcohol or drugs. You should consult with an attorney regarding all the facts and circumstances as the penalites for DUI are quite severe.
