Relocation out of state

My husband and I want to relocate out of state for better opportunities and his ex is fighting in court to stop the relocation. She has only visited her daughter 8 times in five years with no over nights and now wants to be part of her life. Will we still be able to go?

These are not simple cases. The court looks to many factors. Since it is so much fact driven, you would be well advised to meet with an attorney. Since this matter is already in court, based on your description, I urge prompt action.

Among the factors to be considered is how the move will impact the parent-child relationship and whether the move is for a legitimate purpose. Will the move benefit the child more than it will harm the absent parent? Other factors may have an impact on the outcome.
