Legal Question in Wills and Trusts in New Hampshire

My childrens uncle is trying to take over my x husbands estate

My childrens father was recently killed in a car accident. We have been divorced for 4 years and their is going to be a civil suit because the driver that hit him was on drugs.

We are doing what we can to give something to our kids for college and for tragically losing their father. In my divorce decree it names me as the beneficiarry if he doesn't maintain a life insurance policy of 250,000(which he didn't) All in all I received a letter from my former brother in law... motioning to be the executor of the kids fathers estate. Despite initially being disgusted that he did this a week after his own brothers death, I'm appaled he won;t allow me to make my own decissions for kids future as I have done for the past 12 years. I fear he is only trying to get his paws on a good deal of money. I wouldn't be suprised if he tries to go after his social security also. What are my rights? and what is the best way to deal with this?
