Legal Question in Banking Law in New Jersey

My husband forged my name on a home equity and a second mortgage from the same bank. It was notartized by the same person who he knew for a long time. Can I sue the bank? And can my soon to be ex go to jail?

If your husband is your soon-to-be ex, I would imagine that you have a lawyer. Ask him or her. Suggest that the notary is also liable for any damages. � See also: http://info.corbettlaw.net/lawguru.htm

No, unless the bank did something wrong or knew about this fraud. However, the bank does NOT have your signature on the mortgage, and you should fight to prove this.

Yes, your ex and also the notary.

Do you have a lawyer? all of this should be right in the middle of any divorce lawsuit, and you should be fighting very hard against this.
