Credit Card Debt

A debt collector sent me a notice that they obtained a debt that I owe from a credit card thats over 10 years past I do not even remmeber this acct and when I sold my house back in 05 all debt that I owed was paid off before I was paid the balance what is the statue of limitations on this I am in NJ.

Tell the debt collector that the debt is well beyond the statute of limitations and he knows it. Tell him that if he persists, you will sue for violation of the Fair Debt Collection Practices Act. Then do it.

I agree with Mr. Corbett. I don't think you need an attorney here, at least not yet. Do what Mr. Corbett told you to do, keep all your info and send it certified mail. Also demand that they remove it from your credit report. Check it in about a month to see if they did it. If they didn't, ask for an investigation into the debt with all three reporting agencies and attach your letter to them.

If they sue you, get a lawyer. you may be able to 'counterclaim' (sue them back) for violating the Federal Fair Debt Collection Practices Act. You should put them on notice, by sending a letter that says they should stop pursuing this debt because it is barred by the statute of limitations. send that letter certified mail return receipt requested (keep the return receipt, the green card).
