Joseph Grassi is correct in his answer. Just to add, if someone is with someone under the age of 16 they are facing jail time. The jail time is between 5-10 years with a presumptive of 7, the person will have to serve 85% of the sentence.

Re: Age of Consent for sexual activity in NJ

The answer is it depends. So long as you are not a parent, teacher, or exercising supervisory control, ie a boss or something like that, your partner can be 16, no matter how much older than 18 you are. If do have supervisory control, your partner must be over 18 or older.

If your partner younger than 13, he or she can't consent to sexual relations. If your partner is between 13 and 16, they can consent, but not with someone more than 4 years older - so that 13 year old could have legal relations with a 17 year old, but not an 18 year old.

Be safe please.
