Legal Question in Criminal Law in New Jersey

charges are 2c:35-10A and 2c:36-2

Recently i was at my house with a friend who had to much to drink. My mother called the police because he was extremely intoxicated. When the cops arrived my friend was in the living room laying on the floor. The cops asked me where he got the alcholol and i told them that he had already been drinking. They then walked down my hallway into my bathroom and then into my bedroom without my permission. Then they searched around and found an emtpy baggie in my gararbage along with blunt guts and what they said was some flakes of marijuana. Would that be considered an illegal search? im on conditional discharge right now and i can not afford a criminal record and anymore penalties for such a bullshit charge.

I would have to see what their side of the story is since that is what will really drive the issue. Regardless, you need a good attorney to handle the motion. I practice in any court in NJ, so call me at 732/247/3340 to discuss your case.
