At what age can a child

I have a 17yr old son who is currently living with his father under ''joint custody'' in New Jersey. Can my son legally choose to live with me in Texas.

Hi,

It depends, people mistakenly confuse visitation/parenting time with custody. How is the "joint custody" arrangement set up? Is it by court order? That document would be the starting point. If the judgment or order doesn't allow it, then your son can go to Texas if his father agrees. I would get this reduced to a Consent Order.

When your son is 18 he can decide where he wants to live. Now, if the father has an order giving him residential custody of your son you son must remain where he is until or unless the Court enters an Order changing this arrangement.

It depends on a couple of things, the most important is what your divorce judgment and divorce agreement say. If you have to go to Court, then your son's wishes at age 17 will be taken into account very strongly by the Judge.
