Legal Question in Family Law in New Jersey

I have two basic questions and I want to give you some background with regard to my situation. I am going on my 3rd year being divorce.. My ex still resides my home that was awarded to me at the final court hearing.. In the decree it stipulated that I had to refinance within a certain period and have his name removed from the mortgage..which leads me to my first question... since I had initiated my divorce my credit has suffered. I feel that since I only have 6 years keft on the term of the loan anyway why should I refiance at this time. Which is one reason he refuses to go which is making my life miserable. Then my second question... Tax filings.. last year I claimed my daughter, head of household and the house and taxes on my return... We are to alternate years claiming my daugter.. my question is.. since the house was awarded to me do I have to split the house and taxes deduction since I have not removed him from the mortgage even though the house was legally awarded to me in a court of law or does all of that deminsh due to me not having refianced in the time alloted me in the decree? I
