Legal Question in Family Law in New Jersey

child support. college student.

i have one son in college. he is living at the college. it was court ordered that i pay 75% of tuition and room and board and books, and his mother pay 25% based on our incomes. child support was dropped. this fall my other son will be attending a different college and will also be living on campus. i'm expecting that child support will also be dropped for him. my attorney informs me that child support may not be dropped because his mother is still continuing to make a home for him even though he is living at school. my question is, ''am i obligated to pay child support and 75% of tuition and room and board?'' it doesn't make sense to pay support to his mother for room and board when he'll be living on campus. the judge dropped support for my older son based on the fact that i'm paying most of the cost for college.

hope you can shed some light on this since i'm in the dark on this.

thank you.

Re: child support while child is a college student.

It is hard to answer your question without knowing all of the facts. It seems to me that the Judge has set a precedent with your first child. However, it is possible that your attorney has seen something else in the other information that you provided to him/her that makes him/her come to the conclusion that the response would be different for your second child. If you are dissatisfied with your attorney's response, seek another opinion. I will be happy to assist you. However, you need to call me at 856-546-8010.
