Child Support and Second Families

My husband has a child support order for his 3 children. We are now expecting our first child how will this effect his current CS order? I know my pay comes into play but to what degree?

You need some advice from a good family law attorney. I suggest that you sit down with a divorce lawyer, pay him or her for the consultation, and get some idea as to how to proceed.

You may want to ask the Court to reduce the child support because of your husband's new little dependent.

His obligation to the three children must be recalculated once his new child is born. A double calculation is required.

First his obligation to his new child under the New Jersey Child Support Guidelines must be done. To do this your and his weekly income amounts and any child care expenses for the new child are used to calculate his child support and child care obligations for the new child. After this calculation is done for your new child this child support and child care obligation is then plugged into the guidelines computer program as a form of offset in order to calculate his new child support calculation for his first three children.

You are not obligated to support his first three children.
