Custody to someone other than father

My husband's sister and her abusive boyfriend split up. He agreed to give up custody only of my husband takes custody of 3 year-old girl. Question: Can he do that so that my husband and his sister (the mother) are the only ones with the child's custody, and by doing this, what rights does the father give up?

I'm not sure if you are asking about custody or whether you really mean that the father wants to give up all paternity rights. The latter is unlikely to be permitted by the Courts. The former is certainly a possibility, but would not relieve the father of child support obligations. You need to learn more about what is meant by "custody." There are many substantial ramifications to your questions. I have tried to give you an answer based purely on the little bit of information that you have given to me.
