Legal Question in Family Law in New Jersey

Housing

My ex and his pregnant girl friend are moving in together now that their baby is due. We share 50-50 custody of our children. When the baby comes the five of them will be residing in a two bedroom apartment. They are expecting my 11 year old daughter and my 7 year old son to share a room with their newborn. Is there any way I can utilize this situation to regain custody of my children in New Jersey?

This is a miserable situation on his part. If you file a motion asking the Judge to terminate the shared custody and give you sole custody, then the Judge will have to decide what is in the best interests of your children.

Overcrowding in his apartment would be a factor in the Judge's decision. The Judge would take into account many other things as well.

Yes, this is a frequently used argument. However, these cases do not occur in a vacuum and I'm sure there are other attorneys. I would consult with an attorney before you do anything.
