Legal Question in Family Law in New Jersey

Im married and have a daughter with another woman. She is 2 years old and her living conditions are horrible. She lives in an illegal basement and in total filth. My living conditions with my wife are way better.

We had our daughter over everyweek for 3-4 days. I also give child support monthly. Recently a disaster occured.

I cheated on my wife with the baby mother. All is out in the open and we are fighting together to get past this.

Will this cause an issue if I were to go for full custody? Given the ,"best interests of the child." And hazardous living conditions?

The baby mother also lives with both of her parents, her sister, and another 4year old daughter.

Please advise me!

You pretty much answered your own question. You are correct that all custody decisions are made in the best interests of the child. If you can establish that you would have a better living situation for the child, you would win. If you cannot, you won't. It is always best to have an attorney represent you in these situations.

Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, you should contact a Family Law attorney to discuss your matter in more detail. Only then will you be able to rely on the advice. Good luck!
