Legal Question in Family Law in New Jersey

Moving to a different state with my kids.

I currently live in New Jersey. I am being told that I can't leave New Jersey. I am 22 years old and have 2 children. I am wanting to move back Texas with my mother. So I can better support my kids and have the help of my family. I have no support from my ex husband. It is not stated in the divorce papers that I can't leave. Help on this matter would help me greatly.

Thank you for your inquiry.

Under both state and federal law, you cannot remove the minor children from New Jersey without

either a Consent Order or an Order from the Superior Court allowing you to do so. However, I believe that the fact that you have family in Texas will help your case significantly. Finally, there is a very recent Supreme Court case that has changed the law regarding the removal of children.
