What are my rights?

I am 23 and I have a 6 month old son. The father is in jail and his parents are trying to take over. What are my rights as a parent? Should I file for full custody and will that mean he signs over his rights?

The best advice I can give you is to seek the advice of an attorney immediately. Basically, with the father in jail, assuming you have the physical ability to take care of the child, it will be almost automatic for you to have sole legal custody of your child, at least for the time being. His parents would likely only be able to take control if you were neglecting your duties as a parent. The child's father would not automatically have his parental rights terminated. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion.
