Can I sue for damages?

For more than one year,I have been owed over $38,000. The lawyer for the person who owes me the money, even though he acknowledges, I am due the money refuses to pay me, unless I waive all rights to sue for damages.

sounds like you need to sue him, unless, there are no other damages. If there are none, what is the harm in signing off
