Legal Question in Personal Injury in New Jersey

Mal practice Shoulder inury

I had a sholder injury with a labrum tear that happened at work. I had surgery to fix the shoulder that required 6 screws. After surgery I went to PT and was working with a therapist.

The therapist had me doing the wrong excercises that the ortho doctor did not prescribe including workimng with the wrong weight.

As a result I re-tore my labrum within 6 months of the original surgery and they had to do a revision surgery that required an aditional 5 screws (for a total of 11 screws).

I beleive that the reason I needed the revision surgery was because of the physical threapist having me do the wrong excercises and not listening to the ortho's recommendation about the weight limit.

Do I have a cause for litigation against the Physical therapist?

If ultimately your shoulder's condition and/or its prognosis for recovery has been worsened, you may have a meritorious claim against the therapist. It is important that your treating orthopedist be of the opinion that the worsened condition and the revision surgery were caused and necessitated by the contraindicated or negligently performed therapy.
