Personal Property Damage

While living w/ ex-girlfriend and her 19 yr old son in her home, he purposely, knowingly, and willfully damaged or stole my personal property (est'd fmv $11000-12000). Her son is not a US citizen. He left the US on the day of the incident. A police report was filed and she filed a claim w/ her insurance co. (it was denied). She has an US work visa.

Can I sue her for the damages (e.g., neglience)as a third party?
