Legal Question in Real Estate Law in New Jersey

Closing Procedures

My closing attorney has not provided any direction while purchasing our first home. He doesn't return phone calls and his secretary has provided little information when I call with questions. I asked about closing figures and she told me I had to wait until the day before. Now we are told they are shooting for a specific date when we were originally told this was the closing date. Is this normal? I feel we are getting bad service and do not know what to do?

Re: Closing Procedures

Please be advised that I have not been retained to represent you and I am basing this response on the limited amount of information supplied. However, your attorney should be able to provide an estimated amount of closing costs. he is correct that the exact amount may not be known until the day before closing. You can also try to obtain closing fees from your mortgage lender. If you are unhappy with the services of your attorney, you are able to hire someone else to represent you. If you wish to speak with me in greater detail, I can be reached at 908-537-7975.

Good Luck!

Re: Bad legal representation

Yes, you are getting bad service. While it is true that a substantial amount of information will not be available until one week - one day prior to the closing, this is no excuse for a lack of communication. Hopefully, your lawyer is competent but lacks the skills or time to keep in touch with you. In that case, your closing will be completed properly, albeit with a lot of angst on your part. In any case, you might want to schedule an appointment with the attorney now to get some information, face to face, for your own peace of mind. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, you may want to contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. Feel free to call me for an appointment at 856-546-8010. Mention LawGuru and your first one hour consultation is free. Good luck! Rob Gleaner
