joint ownership of house

I own primary residence house with my brother. Now with various issues want to live seperately. What are my legal rights and/or how can i sell or buy his share?

If you have an agreement with your brother as to the price to be paid then a lawyer can draft the necessary documents for you to buy him out.

If there is a mortgage in both names the property will need to be refinanced.

If there is no agreement as to buyout, alawyer can bring an action to force the sale of the property.

I have read what the other attorney wrote, and he is pretty much correct.

I have done a couple of cases like this, and it is always better to start by trying to get an agreement between the owners. If you can not agree on what is to be done, then you can go to court. Court costs a lot more money, so you avoid it if you can.
