Legal Question in Real Estate Law in New Jersey

Managmenet a condo association -- expenses when crazy -- so I opened up a credit card in the Association's name and they asked me for my social security card. So I gave it to them -- not knowing that I would always be responsible for that card and not the Association. Now another Management Company took over and said they will not pay the credit card even though all the expenses on that card was used for the Association. The card is about $16,000 and I do not want to ruin my credit. What can I do please help. Can't sleep at night.

You have already tried being nice and asking them to pay the condo association's debt. Now you need a lawyer to push them hard, and if they still will not be reasonable, you will sue the condo association and maybe the management companies (old company and new company). I would need more info to tell you anything more.

Put ALL demands in writing, and give them a fixed period of time to respond (say 7-10 days), and tell them if no response, that you will file suit. Tell them the association will be responsible for any payments made (to prevent the card from defaulting), for any interest, fees and legal costs incurred to recover payment, and that they may be liable for defamation of credit. Send the letter to the old management company, the new management company, and each board member. If they pay, problem solved, if they do not, you have to file suit. Your problem is, as soon as you get over $15,000, you must go to Law Division, not Special Civil Part, and if they do not pay you then, you may be in Law Division for 18 months before you get to trial, vs-2-3 months in Sp. Civil Part. There are a lot of questions, so get our paperwork together... WHY would you put your name on a card? The association should have an EIN, and CAN get a card, like any business, so who fed you that line of crap??? How did they pay for using the card in your name in the past? Who on the Board knew of this (I assume all of them)? Why did you put your name on it, why not someone else? As long as the purchases were not for you, but for the association, there should not be a problem at court. Chances are you will need to hire an attorney, which if it settles quick, will cost you $1,000 to several thousand. If it drags on to trial, who knows, it depands upon how much time! Good luck!
