Legal Question in Real Estate Law in New Jersey

question - I live in a townhouse in Mahwah, it seems the buildings are slowly sinking due to poor construction - with that the water pipe are breaking inside the buildings -

remember this comes from the street and the town owns them - but the assoc, is making the homeowner pay for the replacement of these pipes - yes we own the building but not the land, tell me is this legal for them to do so? doesn't the town own the water pipes? I don't think they can get away with doing this? please advise. thank you Barbara
