Legal Question in Traffic Law in New Jersey

can i appeal a traffic violation and if so how much time do i have

about a month and a half ago i was pulled over and was told my license was suspened. due to the fact that i had previously recieved my 5 yr abstract 3 day's prior to getting pulled over and there was no suspension or pending suspension on it i was unaware that my license had been suspended on the very day that i was pulled over. when i went to court they downgraded the offense to unlicensed driver which is still a moving violation. because that was a third moving violation for me in 3 yrs my job informed me that this could jeopardize my employment if this offense isn't removed from my driving. is it possible for me to appeal this charge w/ an attorney given the circumstances?

If you had no knowledge you were suspended because the suspension happened the day you were stopped you should not have pled guilty to anything. I can apply to vacate your guilty plea and have the charge dismissed.

Call me if you like.

Re: can i appeal a traffic violation and if so how much time do i have

First of all, "unlicensed driver" is not a "moving violation", it is a "credentials violation". Pleading guilty to that offense carries no state motor vehicle points. And, in any case, it is unclear how either a "moving violation" or any other violation would impact on your employment, from the information provided in your question.

Bottom line is that you should not have pled guilty to even being an unlicensed driver in that notice is required. You need to get an attorney immediately to rectify this situation.

Keep in mind that this advice is given based on the little bit of information that you have

provided in your question. My advice may change based on other information. Further, no one

can rely on advice from an attorney who has not been retained. You cannot rely on this advice

because we have not personally met and you have not retained me as an attorney. If you have not

already done so, you should immediately meet with an attorney for a full consultation before you

take any further steps. You may feel free to call me to discuss this matter in more detail. If you

do so, mention Law Guru and your first one hour of time will be free. Good luck! Rob Gleaner
