Changing Lanes

I was travelling on middle lane on a 3 lane highway. A car on the left lane tried to make an exit and cut through infront of me and tried to get to the right lane to exit. They weren't able to make it all the way and was diagonal with the rear of their car sticking diagonally in my lane. I tried to stop but couldn't due to the rain the short distance between my car and their car. My front right corner hit their back left bumper which was in an angle because their car was diagonal between the two lanes. It was also raining heavily. Is it my fault since I hit them in the back or is it their fault for trying to cross 2 lanes with not enough room infront of me and not making it all the way to the right lane?

There is no clear answer to this at this time. Were either you or the other driver issued a traffic ticket? If you were, then this is a case where you may have a defense to the ticket and could take the case to trial. If not, but the other driver was given a ticket, that means the police at the very least thought the other driver was at fault. If a law suit results from this accident, then the attorneys for both parties will have to fight it out to see who is liable. This sounds like the other car cut you off, and therefore was at fault. If you sustained personal injury you may have a right to sue that other driver for pain and suffering. Sounds like the other driver is more at fault than you are. There is probably fault on each side but with the higher percentage on the person who cut you off. Therefore, if you were injured then you would still be able to make a claim for personal injury. If you wanted to write the other person a ticket, you could do that as well.
