rear ended by a car

i was living between philadelphia and stratfoed.most of the time in philadelphia. i was rear ended by a car when i was visiting my girlfriend in NJ. i had no insurance.i was not hurt,minor neck pain.

my question is how can i claim for the damage to my car.'cos i dont have the money to fix it and cant afford a new one.

insurance companies have something called un insured motorist.

should the insurance company of the other party compensate me. the police report says its their fault. my car was stopped bya truck in front of me trying to make a left turn and the car came and hit me....

pls help!!!!

Your insurance status does not matter for property damage claims. If the other party is at fault you are entitled to the repairs and the rental expense while it is immobilized. I offer free consultations. My contact information is in my profile.

I can not give legal advise as we do not have a legal relationship, I do not have all the facts, and this is not my area of law, but I can offer you the following comments...

Don't listen to ANYTHING the insurance company tells you - THEY LIE about damn near everything. Get EVERYTHING in writing, and confirm you conversations with them in writing!!!

If it was their fault, your property damage is covered. They will try to screw you on the cost fo repair 95% of the time - don't let them.

Ask them if they guarntee repairs done at their approved repair shops, and go there, but get your own estimate first. Fight for the best repair you can get.

You are also entitled to a rental car - don't ask for it, call them and ask them which rental outfit to go to to get your rental (they get a pre-agreed upon rate lower than you or I will).

If you were not insured, any personal injury damages may be limited or not allowed (as punishment for not insuring your car as required). IS insurance required in PA? If not, you may avoid the penalty of limitations on personal injury.
