Legal Question in Traffic Law in New Jersey

I was cited for failure to yield to pedestrians by Rowan University Police. The officer told me that I have to stop for pedestrians that are not even in the crosswalk. The pedestrians that are standing at the corner of the crosswalk also need to be yielded to. Is this true?

The statute provides that the pedestrian must technically be within the crosswalk before the operator of a motor vehicle is required to fully yield. Both the driver and the pedestrian must exercise due care. You should obviously take notice of the pedestrian, but again they must be in the crosswalk. This is a two point violation. You can get a lawyer but if your record is relatively clear, you could also speak to the prosecutor about the situation on your own. He or she will probably offer to downgrade your ticket to a no point violation. However, if you obviously feel that you are not guilty, you can go to trial and let the Judge decide.
