Whom do I sue

My legally parked car was hit and the person's insurace doesn't want to pay the blue book value. Whom do I sue the insurance company or the person who hit me?

You need to sue both the person driving the car as well as the person who owns the car, together with any other person that may be responsible for the accident. The insurance company does not get sued but they should represent the defendants that are named. If the defendants are uninsured then your company may be responsible for paying. You should sue the operator/owner of the car that hit your car. An attorney might be of help.

In New JErsey, you sue the owner of the vehicle. Once the owner is served with the Complaint, his insurance company will contact you to settle his claim or they will defend the case by filing an answer and you can settle before trial or have a trial before a judge. You should be prepared with book value information.
