Legal Question in Traffic Law in New Jersey

unattended vehicle parked on private property struck

hi...my vehicle was parked in my friends front yard(along the road) when it was backed into by the neighbor. The vehicle was unattended. the local police were called and a report was filed. The officer said that I was 100% legally parked and if i were not he would have issued me a ticket. The neighbor's insurance is giving me a difficult time about paying for the damages. I have only liability on my vehicle...so no one is on my side. What can I do? oh, by the way I did take pictures of the accident scene.

Re: unattended vehicle parked on private property struck

You may have no choice but to file a law suit against the person who hit your car. In that case, the insurance company for the owner will be forced to defend and, I would think, likely settle the claim. Depending on the cost of repair, it is likely that you will be able to file yourself in Small Claims Court. Keep in mind that this advice is given based on the little bit of information that you have provided in your question. My advice may change based on other information. Further, no one can rely on advice from an attorney who has not been retained. You cannot rely on this advice because we have not personally met and you have not retained me as an attorney. If you have not already done so, you should immediately meet with an attorney for a full consultation before you take any further steps. You may feel free to call me [856-546-8010] to discuss this matter in more detail. If you do so, mention Law Guru and your first one hour of time will be free. Good luck! Rob Gleaner
