Legal Question in Personal Injury in New York

I was sentenced to Court Mandated "Community Service" pursuant to P.L. section 65.10(1)(2)(h). While performing the Court Mandated "Community Service " I was seriously injured. Am I considered a volunteer under the legal definition of volunteer or Am I a person suffered under the legal definition of Labor Law section 240

The statutory language covers those lawfully frequenting the property and does not have a wage earning requirement. However, you must have been performing an enumerated activity such as painting or construction, demolition.

This is an interesting issue. Even assuming its not a labor law case, you may still have a case against the City or other entity.
