Legal Question in Bankruptcy in New York

lawsuit + bankruptcy

ive been named in a lawsuit recently and have a court date in the next couple of weeks. i have been out of work for some time and am considering filing bankruptcy. will i have any protection? will bankruptcy protect me on debts before it is complete or will it also protect me on debts after it is completed?

As soon as you file for bankruptcy relief, you will get the benefit of protection from your creditors by virtue of the automatic federal stay.

This is the very powerful provision of bankruptcy law that prevents creditors from taking any further action against you to collect a debt, and that means that any law suits or litigation against you must come to a stop.

The stay goes into effect the minute your petition is filed with the court.
