Legal Question in Credit and Debt Law in New York

Collections, debt

My checking account was put on a hold and charged 2x the amount of money that I owe the creditor. The only income I have is my husband's job(direct deposit check) and now we have no money to survive on. Can a creditor take all of yor money, even if it means that you will literally have NOTHING?

Re: Collections, debt

Maybe, maybe not. It depends on several factors, including the source of funds in the account. In addition, recent paychecks may not be frozen. You will need to file a show cause in your local court to get the funds released. Call the court and ask how to file a show cause, or contact an attorney.
