Legal Question in Credit and Debt Law in New York

purchasing lease car

I had a leased car with a major bank and decided to purchase it at the end of the lease. I took out a loan and paid off the car. But, they forget to charge me sales tax. I had been in correspondence with the bank for one and a half months to try and fix the problem. Then, they lost the check I had sent them in their system. They repossesd my car. So, they had my money and the car. I have a signed contract(lease and purchase agreement) and a copy of the check that the bank cashed, yet they still took my car. They claimed I owed more money as they forgot to charge me sales tax. I went to a local branch and paid the amount despite it being above what my contract stated.

Despite the fact they have all of my money and my car, I am unable to get my car back at this time.

Can a I sue a major bank or take them to small clims court for the amount above the contract amount as well as for the fees incurred while the car was repossed?

yes. If they did you wrong you can sue them in small claims court for up to $5000 in New York City.
