Wage Garnishment

In Jan 2008 ,y husband and I loaned $1400 to his brother for car repairs. A promissory note, notorized and signed was written requesting payment of $50 a month. One payment has been made and reminders posted to him and no payments made. We need to collect this money, can we garnish his wages?

You may issue an income execution only after you receive a judgment. Therefore, I would suggest taking your husband's brother to small claims court.
