Legal Question in Criminal Law in New York

Drug Offense

My friend was set up. He went to buy a bag of crack and when he got to the destination a man comes up to him and ask him to get him a bag. He gets the guy 1 twenty dollar bag of crack for him and 1 for himself. Right after he gave the guy the bag he got arrested. The guy was a DEA agent. They put him in a van and wait for the dealer to come out. They arrest the dealer beacause he has the 2 marked twenty dollar bills on him but no drugs. My frind is an addict not a dealer. He has been in jail for a month now. He went to court but his codefendent had it postponed till Oct.10. He was first charged with a felony and $10,000.00 cash bail. But now they are dropping his charges to a misdemeanor. Is there anyway to get him a court date sooner or get the bail dropped or even released. He has 2 priors 1 in 1998 for 1 twenty dollar bag of cocaine and a agrravated assault charge in April 2007 that was dismissed. He has a legal aid that is not doing much. Any advice would be greatly appreciated. Thank you for your valuable time.

Re: Drug Offense

The attorney can make a motion to get the bail reduced, because there is a change of circumstances. When a felony charge is reduced to a misdemeanor it is common for the bail to also be reduced. You friend can always retain a private attorney if he is not happy with his legal aid representation. Please feel free to contact my office if we may be of any assistance.
