dwi in ny with a florida license

Ok this is a really crazy situation i received a dwi in NY and i am a resident of florida but i was not behind the wheel when it was issued to me the vehicle was my wifes and there was an accident there were passengers in the car we left the car to go get help to tow the car the passengers wound up calling for a ride after we were unable to locate help i went to a friends house a few miles away and when i seen the police go by i went back to the seen i was drinking at my friends house prior to going baack to the scene but i was charged with the dwi because they said because it was my car i was driving and i was intoxicated at the time of the accident i stated that i was not driving but could not provide a driver because the others went home and did not want to be invlolved i was taken to jail and let go with a dwi ticket and failure to maintain my lane but was never arraigned then my court date was post poned for a month making it a month and a half since the inncident and still no arraignment also no evidence that i was driving can they convict me and if they can how will this affect my license in florida i have a federal job and i drive for a living i have a cdl in florida but this inncident was in NY please shed some light

You have a number of different issues to worry about. Depending on the charge you may have your driver's license revoked and this may impact your job status. Since there was an accident involved in this case the prosecutor may make a higher than normal offer. If you go to court and the paperwork is not yet prepared it starts the clock running on the prosecutor who has only a certain amount of time to proceed to trial. The amount of time the prosecutor has is based on the top charge. I have handled hundreds of DWI cases in New York. Depending on how your case is handled there is certainly the possibility of having your FL license revoked. The accident needs to be addressed as well and clarity on whether you were driving or not will certainly impact the case. Whether you have ever been arrested or have any criminal record will also have an affect on negotiating a plea for you. Either way you absolutely need to have an attorney representing you in Court. A N.Y. conviction will affect your criminal record,your CDL and your Florida drivers license and driving privileges. You need a competent DWI defense attorney to help you. The DA has to have you arraigned and be ready for trial within a given time period in N.Y. ,that begins upon arraignment. Because you had an accident a good plea bargain may not be initially possible. However the passengers in the car that night are the key, their statements to the police and the DA hold the key to your fortunes. My name is Shawn Kassman, I represent a number of people who have been charged with DWI. Did you take the Breathalyzer test? Or did you refuse the test?

If you are found guilty of driving while intoxicated this is a misdemeanor, you will have a criminal record.

You have two options we can attempt to plea bargain the case so that it gets reduced to a violation if they will not do that then you have a right to a trial. At which time they have to prove you guilty beyond a reasonable doubt.
