Legal Question in Criminal Law in New York

False Arrest

My husband was arrested today and put in a line up for a crime he didn't commit. He was picked out by three people while in the line up. We know for a fact he didn't commit this crime because our family was all together the night that it happened. They said they have the real criminal's DNA and my husband gave them the permission to take his DNA. Now after the line up they won't take his DNA. Even though that will get him off the hook. My children are scared, I'm scared and my husband is completely confused. Please can someone tell us what to do. We don't have money to pay for expensive lawyers. I'm ill over this.
