Legal Question in Criminal Law in New York

Parole rules and regulations

Parolie that is in drug counseling gives a dirty toxin, admits his quilt to counselor and asks for help. He gets a bed in a rehab for Friday morning and asks for a later time because he wants to be able to say goodbye to his son! Counselor gets him a bed for Monday morning so he gets the weekends with his son. Parole officer calls the counselor and tell him to get the early time back. Is this legal? AND If he does not go to inpatient can his parole officer violate him? OR what would happen if he decided to keep the outpatient counseling instead?

Re: Parole rules and regulations

Yes, it is legal. Based on the failed urinalysis, the parolee can be violated by his parole officer. parole Officer gave the parolee another second chance (parole was his first shot at a second chance). If the parolee CHOOSES to ignore this, then he has CHOSEN to be violated. In short, he can go to the inpatient program starting Friday or don't complain about being violated and returned to prison.
