Legal Question in Discrimination Law in New York

disrimination of dog owners

Hi,

My friend has recently bought a house in a new house development in Croton on Hudson in NY. Unfortunately the association has a no dogs policy. Which they were hoping to be excused from. They own 2 cocker spaniels that they rescued from living on a chain in a basment. My friend has a medically documented condition, she gets panic attacks when alone. Having a dog is not just having a pet it also means no more attacks.

Now they are being asked to pay $50.00 a day per dog if they want to keep them.

What can they do? Is there anyway that they can fight this injustice and discrimination.

While courts have upheld such agreements in the past, you can argue the dogs represent an 'accomodation' to a disability.

The NY State Division of Human Rights is a good place to start. If they are not cooperative, then get back to me and I can help you.
