Legal Question in Discrimination Law in New York

swastika

It it ileagal to draw a swastika and considered legally an act of anti semitism? My son got caught drawing a swastika in the boys bathroom in school (Public). They marked his file as him being anti semitic, and i would like this removed, it was not done in a hate related matter or environment.

Wasn't in a "hate related manner"? In what manner was it meant? Sounds like your kid needs some counseling: vandalizing property (public or private) with images of hate is a crime any way you slice it.

Rather than making excuses for your son, it's time to have a talk with him about the meaning of a swastika if he truly didn't understand what it meant. Your son got off easy, in that all he got was a notation. Many people would have been arrested for being caught doing this kind of vandalism. Take it as a warning sign.
