Legal Question in DUI Law in New York

Drunk driving

We are a volunteer fire dept with a clubroom where members can drink, there is a donation list and members can serve themselves, the question is if a member gets to drunk to drive but does anyway and gets in an accident is the club liable for being sued?

Good question. Obviously you have researched the NY dram shop law. Well I guess just like a regular bar if someone was obviously intoxicated they should not be served. On the other hand the patrons of the club serve themselves and their are no bartenders.

Tough tough question.

I hate to see this but I think you are going to have to talk to your insurance company tell them about your plan (pay the extra $) and pay a private commercial lawyer to get an answer.You may also want to find out who is the lawyer of the local knights of columbus, knights club etc. to get an answer your question.
