Legal Question in Entertainment Law in New York

covering and recording a song, copyright issues

I sang and recorded a tune, copyrighted in 1969, by another artist. This was for no profit, and purely for audition demo purposes. The producer I used is putting together a promo CD of some of the artists who have recorded in his studio, again not for profit, just as a showcase. What are the copyright issues regarding the song I recorded? Would I need to contact ASCAP and pay a use fee? Thanks.

Re: covering and recording a song, copyright issues

If the song hasn't been recorded and released you'd need permission from the copyright owner. If it has been recorded, generally you can record it but will have to pay mechanical royalties if your recording is released.
