abandonment

wife walked out it been three weeks .

someone told me about (abandonment)

how do i found out info on this .

if i choose to go this rout what are the right steps.

Re: abandonment

Divorce by abandonment may be found under NY DRL 170(2). The statute states, "An action for divorce may be maintained by a husband or wife to procure a judgment divorcing the parties and dissolving the marriage on any of the following grounds: ... (2) The abandonment of the plaintiff by the defendant for a period of one or more years."

Therefore the abandonment must be for over 1 year - not three weeks.

The steps to take a divorce are too numerous to be set forth in this answer.
