Legal Question in Family Law in New York

Child Custody

At what age do your children have the right to decide which parent they want to live with. Presently their mother and i have been using a sort of joint custody. (I have them 4 days/week and they don't want to go to the mother's at all.)

My children's ages are 13,16 and 17.The only reason I make them go to the mother's at all is because I feel I presently have the better of the deal. Their mother however, is uncaring and does not take care of them at all. I support them totally and she does nothing for them.

Sincerely,

Re: Child Custody

It is not so much the children's age, it is what is in their best interests. Clearly, that is staying with you.

Suggest you file a petition for modification of custody in the Family Court.

If you wish to discuss this with me privately, please call to schedule a confidential consultation.

I practice in NYC and Long Island.
