Legal Question in Family Law in New York

Credit card liability during divorce

What is the credit card liability for joint credit card accounts if all the spending is done by one party? Is the other party still liable for these debts on this joint account? Does this liability stop on the day the divorce papers are filed in court?

Re: Credit card liability during divorce

Joint credit cards means that you both are jointly and individually responsible for the debt. It does not end when divorced. You would need to enter into a stipulation w/ Xhusb as to who is paying what and get it on record/ordered. If you have not done so, you must close the account now.
