Legal Question in Family Law in New York

Custodial Parent wants to move out of state with children

Through court papers, I am the non-custodial parent to my 8 and 6 year old children. I have court ordered visitation every other weekend and every other holiday. My ex girlfriend says that she is thinking of moving to Florida with the children and there is nothing I can do about it. We all live in New York State now. Is she allowed by law to move my children so far away from me?

No. She is not. If she intends to carry out her threat, you can petition the Family Court for custody. If she moves you have up to 6 months to file and serve the petition.
