Legal Question in Family Law in New York

My ex-husband wants custody and we are moving out of state

My ex-husband has some visitation of our two boys (8 & 9). My husband and I are moving from NY to AZ due to military and career changes. The boys want to live with us (as they do now) and their baby sister. My ex is getting out of control and is scaring the boys to the point that they don't wabt to visit let alone live with him. We are willing to fly them back for a visit with their birth father once a month, but he won't take the deal. What can we do. My orders state I have to report to my new unit in 3 weeks!!! I'm not leaving my sons behind!

You have to make application to the Family Court for modification of custody and visitation rights, in essence giving you permission to move out of New York.
